At the very outset, Mr. Dhurandhar, Advocate would submit that against the order passed by the Registrar, Cooperative Society, C.G., a second appeal lies before the Cooperative Tribunal according to the provision of Section 78(2) of the Chhattisgarh Cooperative Societies Act, 1960 (for short ‘the Act of 1960’). He would further submit that the order was passed by the Registrar, Cooperative Societies way back on 30.03.2016, whereas, prescribed period of limitation to prefer a second appeal is 60 -2- days. He would contend that the petitioner may be permitted to prefer a duly constituted appeal before the Second Appellate Authority i.e. Cooperative Tribunal and the said authority may be directed to consider the appeal on merits. 2. On the other hand, Mr. Tiwari, Advocate appearing for the respondent would oppose submission. 3. Heard the learned counsel appearing for the parties and perused the record. 4. Taking into consideration submissions advanced by the petitioner, this petition is disposed of reserving liberty in favour of the petitioner to prefer a second appeal under the provision of Section 78 (2) of the Act of 1960 before the Cooperative Tribunal, within a period of 30 days from today and in turn, the Second Appellate Authority i.e. Cooperative Tribunal shall make all endevours to conclude the proceedings preferably within a period of 120 days from the date of filing of second appeal. 5.
