3.
Learned counsel for respondent-NHAI submits that petitioner has remedy to file petition under Section 34 of Arbitration and Conciliation Act, 1996 (for short ‘1996 Act’) before District Judge, thus, petition may be dismissed on the ground of alternative remedy.
4.
Faced with this, learned counsel for petitioner submits that petitioner may be granted liberty to file petition under Section 34 of 1996 Act. The writ petition before this Court was filed because Section 3G of National Highway Act has been declared ultra vires by this Court. Hon’ble Supreme Court in Special Leave Petition (Civil) Diary No.26933/2025 has stayed operation of judgment of this Court. In these circumstances, the petitioner would avail alternative remedy.
5.
In the wake of statement of learned counsel for petitioners, the petitions stand disposed of with liberty to petitioners to avail alternative remedy.
6.
Pending application(s), if any, also stands disposed of.
