1. Matter is heard in presence of learned advocates representing the petitioner and State respondents.
2. It is contended on behalf of petitioner that petitioner’s possession over agricultural land and his right to cultivate the said land is being disturbed and denied by the private respondents prompting the petitioner to approach this Court with the present writ petition seeking necessary directions which will permit the petitioner to enjoy peaceful possession of the said agricultural land.
3. State respondents are represented by learned advocate who has filed a communication dated 29th June, 2026 of Officer-in-Charge, Dhaniakhali Police Station and same is taken on record. Copy of the said communication dated 29th June, 2026 is made over to the learned advocate representing the petitioner
4. It is disclosed in the said communication dated 29th June, 2026 that issue involved in this writ petition is civil in nature. Father of the petitioner distributed land
2 amongst his four sons by executing deed but there is dispute regarding demarcation of land in question.
5. If right of the petitioner to have peaceful possession over land in question is disturbed by private respondents requiring demarcation of plot of land, in that event petitioner needs to approach appropriate forum in pursuit of remedy. Police authority is not the appropriate authority to demarcate land in question.
6. Hence, no relief is granted to the petitioner and the writ petition stands dismissed.
7. However, this order shall not preclude the petitioner to approach appropriate forum in pursuit of remedy.
