Gwalani Chamber Road Vyapar Vihar Road Bilaspur (C.G.) --- Respondent(s) For Appellant : Mr. Shivendra Kumar , Advocate For Respondents : None Hon'ble Shri Justice Sanjay Kumar Jaiswal Judgment on Board (18.08.2026) 1. Heard on admission. 2. This appeal under Section 173 of the Motor Vehicles Act, 1988 [hereinafter referred to as "the Act of 1988"] has been preferred by the appellants/claimants seeking enhancement of compensation, challenging the impugned award dated 30.04.2026 passed in Claim Case No. 13/2024, whereby the learned Claims Tribunal has awarded a total sum of Rs. 03,01,072/- as compensation for the injuries sustained by Sanjay Kumar, aged 25 years, in a road accident which occurred on 05.07.2023. 3. Learned counsel for the appellant/legal heirs of injured Sanjay submits that the learned Claims Tribunal has awarded a meager amount of compensation for the injuries sustained by Sanjay Kumar. He further submits that Sanjay Kumar died on 20.11.2025 and the appellants are the legal 3 heirs of Sanjay Kumar. It is, therefore, prayed that the instant appeal be allowed and the compensation awarded by the Tribunal be suitably enhanced. 4. I have heard learned counsel for the Appellant, considered his rival submissions made hereinabove and have perused the record with utmost circumspection. 5. The claim case was filed by the injured, Sanjay Kumar, before the Tribunal for compensation for the injuries sustained by him in the accident occurred on 05.07.2023. During the pendency of the claim case, Sanjay Kumar died on 20.11.2025. There is nothing on record to show that the death of the deceased was a result of the accident dated 05.07.2023. After the death of Sanjay, the appellants herein were impleaded as legal heirs of Sanjay before the Tribunal. 6. The Claims Tribunal, after appreciation of the oral and documentary evidence available on record, found that the injured Sanjay (died) sustained grievous injuries and also suffered permanent disability, and awarded a total sum of Rs. 3,01,072/- under different heads, which in the considered opinion of this Court is just and proper and warrants no interference. 7. In view of the above discussion, I do not find any illegality or infirmity in the impugned award passed by the learned Claims Tribunal. The appeal, being devoid of merit, is hereby dismissed at admission stage itself. Sd/- (Sanjay Kumar Jaiswal) Judge -Shubham
