1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Bisam Cuttack PS Case No. 157 of 2025 corresponding to TR Case No.22 of 2025 pending in the Court of learned Addl. Sessions Judge-cum-Special Judge, Bissam Cuttack for commission of offences punishable U/Ss. 20(b)(ii)(C)/25/29 of the NDPS Act, on the main allegation of transporting 51Kgs and 300 Grams of Contraband Ganja in a vehicle bearing Registration Number HR-70-B-9444.
3. Heard, Mr. Ranjan Kumar Nayak, learned counsel for the petitioner and Mr. R.B. Mishra, learned Addl. Public Prosecutor in the matter and perused the record.
4. After having considered the rival submissions and taking into consideration the nature and gravity of
the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the recovery and seizure of 51Kgs and 300 Grams of Contraband Ganja, which is well above the commercial quantity from the vehicle allegedly in occupation of the Petitioner and his consequent failure to satisfy the conditions of Sec. 37 of NDPS Act, this Court is not inclined to grant bail to the petitioner.
Hence, the bail application of the petitioner stand rejected. Accordingly, the BLAPL stands disposed of. A soft copy of the order be immediately sent to the learned trial Court.
