29.07.2026 Court No.35 Item No.73 ssi CRM (NDPS) 1487 of 2026
In Re: - An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chapra Police Station Case No. 529 of 2025 dated 06.05.2025 under Sections 21 ( c)/29 of the NDPS Act.
And
In the matter of: Shankarsan Ghosh @ Sankar Ghosh …. Petitioner.
Mr. Snehansu Majumder
..for the petitioner
Mr. Shataroop Purkayastha
Mr. Kuntal Ray ..….for the State
Learned advocate appearing on behalf of the petitioner submits that the petitioner is in custody for 14 months. Till date, the only 3 witnesses have been examined. Prosecution has relied upon 21 witnesses in support of its case.
Learned advocate for the State submits that the evidence of the case is in progress. The independent witnesses are yet to be examined. It has been submitted on behalf of the State that CSW 6 and CSW7 are the independent witnesses.
In view of the petitioner being in custody for 14 months, I direct the learned Trial Court to complete the evidence of CSW 6 and CSW7 by 15th October, 2026. If after the evidence of the seizure list witnesses are completed it appears that the seizure has been diluted because of the deposition of the concerned witnesses. The learned trial Court will not hesitate to release the petitioner on bail.
At this stage, the prayer for bail is rejected.
