It is further submitted that the prosecution itself has acknowledged serious lacunae in the investigation by filing an application under Section 193(3) of the BNSS seeking further investigation, and the applicant cannot be detained indefinitely on account of an incomplete or defective investigation. Learned counsel further submits that the applicant is the sole earning member of his family and his mother is suffering from age-related ailments and requires his care and financial support.
