ORAL ORDER
1. Accused in Crime No.199/2026 registered by Kadugondanahalli Police Station, Bengaluru City, for offences punishable under Sections 69, 351(2), 352 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS, 2023') and Section 66(E) of Information Technology Act, 2000, is before this Court in this petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, (for short ‘BNSS, 2023’) seeking regular bail. 2. Heard learned counsel appearing for the petitioner and learned HCGP appearing for the respondent No.1- State and learned counsel appearing for respondent No.2. 3. FIR in Crime No.199/2026 was registered by Kadugondanahalli Police Station for the aforesaid offences against the petitioner herein based on the first information

dated 11.05.2026, received from the victim lady aged about 29 years. In the said case, petitioner was arrested on 11.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Criminal Misc.No.4753/2026 was rejected on 27.05.2026. Therefore, he is before this Court. 4. In the first information dated 10.05.2026, which was submitted before the Police on 11.05.2026, it is stated that the victim lady met the petitioner in the month of May 2025 in a birthday party and thereafter, they got acquainted with each other. Subsequently, petitioner proposed to marry the victim and in the month of August 2025, he had taken her to a hotel at Devanhalli. In the said hotel after consuming the juice, which the petitioner had given to the victim, she had lost consciousness and the petitioner allegedly had sexual intercourse with her and also recorded her nude photographs and videos. It is further alleged that subsequently, the petitioner blackmailed the victim lady of circulating the said videos

and photographs and had sexual intercourse with her multiple times. It is under these circumstances, the victim lady had approached the Police on 11.05.2026 and submitted a typed complaint dated 10.05.2026. 5. Perusal of the material on record would go to show that the marriage of the petitioner with another girl was performed on 10.05.2026 and only after coming to know the same, the first informant had approached the Police on
11.05.2026. Petitioner, who got married on 10.05.2026 has been arrested in the present case on 11.05.2026.
Investigation of the case is now completed and charge sheet has been filed. 6. Petitioner and the victim lady are known to each other for the last more than one year and merely for the reason that their consensual relationship had failed for certain reasons, criminality cannot be brought in. It is not in dispute that the petitioner has no other criminal antecedents. - 5 -

7. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following order:
ORDER i) The criminal petition is allowed. ii) The petitioner is directed to be enlarged on bail in Crime No.199/2026 registered by Kadugondanahalli Police Station, Bengaluru City, for offences punishable under Sections 69, 351(2), 352 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS, 2023') and Section 66(E) of Information Technology Act, 2000, subject to the following conditions:
a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court

unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
