In the matter of: Bellal Sk @ Hajrat Belal @ Belal Sk. …. Petitioner.
Mr. Niladri Sekhar Ghosh
Mr. Md. Golam Nure Imrohi
Mr. Partha Pratim Sinha
Mr. Souvik Dey
Ms. Labani Sikder
..for the petitioner
Mr. Gurudas Mitra
Mr. Utsav Dutta
..….for the State
Learned advocate appearing on behalf of the petitioner submits that the petitioner is in custody 1 year 4 months and some of the accused persons have been granted anticipatory bail. However, the petitioner’s anticipatory bail was rejected. The petitioner surrendered on 25.03.2025 and since then he is in custody.
Learned advocate appearing on behalf of the State opposes the prayer for bail. It has been informed that 8 witnesses have been examined out of the 22 witnesses cited by the prosecution.
There are incriminating materials appearing against the present petitioner. The trial of the case is smoothly progressing. There are no latches on the part of the prosecution.
Having considered the complicity of the petitioner and the fact that the evidence is at a crucial stage before the learned trial Court, I am not inclined to release the petitioner on bail.
