CRM(M) 1628 of 2026 Dismissed An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Ketugram P.S. Case No.196 of 2025 dated 04.05.2025 under Sections 137(2)/140(3) of the BNS and adding Section 64(1) of the BNS. And In the matter of: Naba Narayan Mondal … petitioner
Mr. Suman De
… for the petitioner
Mr. Ramashish Mukherjee
… for the State
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 2 months. Till date the prosecution has examined one witness and proposes to examine 14 witnesses. As such, there is no possibility of trial being taken to its logical conclusion very soon. So, the petitioner be released on bail on any stringent condition. Learned advocate appearing for the State produces the case diary and draws attention of this Court to the statement of the victim under Section 164 Cr.P.C. as well as statements of other witnesses. Having considered that till date the evidence of the victim is not over, I am not inclined to release the petitioner on bail at this stage.
2 The trial court would ensure that evidence of the victim is completed within a period of 4 months. The petitioner would renew his prayer for bail after the aforesaid time period is over. Accordingly, CRM(M) 1628 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
