29.07.2026 Court No.35 Item No.77 ssi CRM (NDPS) 1495 of 2026 In Re: - An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gazole Police Station Case No. 134 of 2025 dated 08.02.2025 under Sections 21 (c)/25/27A/29 of the NDPS Act. And In the matter of: Rahul Kumar Yadav & another. …. Petitioners. Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick ..for the petitioners Ms. Anita Pandey Mr. Saturdra Lahiri ..….for the State Learned advocate appearing on behalf of the petitioners submits that the petitioners are in custody for about 17 months and the seizure in the present case is 502 grams of brown sugar. Learned counsel appearing on behalf of the State submits that three witnesses are left to be examined. Having considered the quantum of seizure is of commercial quantity and the prosecution case is almost at an advanced stage, I am not inclined to release the petitioners on bail as it has been submitted that three more witnesses are to be examined by the prosecution, the same be concluded within a period of four months. If the prosecution is unable to complete within the aforesaid time period, the learned trial Court would leniently consider the prayer for bail of the petitioners. At this stage, the bail application is rejected. Learned trial Court would adhere to the direction passed above. 2 Consequently, CRM (NDPS) 1495 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
