Mr. Amartya Mohan Bhattacharyya ..for the State Learned advocate appearing on behalf of the petitioner submits that the petitioner is in custody for about 4 years. Till date, only 2 witnesses have been completely examined and the examination-in- chief of P.W.-3 is in progress. Prosecution has relied upon 43 witnesses in order to prove its the case. Learned advocate appearing on behalf of the State submits that the petitioner was identified in the TI parade. It was seen in the CCTV footage, there was recovery of Rs. 80,000/- cash and ornaments. State is unable to apprise this Court regarding the previous antecedent of the petitioner also. Having considered the period of detention of the present petitioner and without entering into the merits of the case, as there is no possibility of the trial being taken to its logical conclusion in near future, I am inclined to release the petitioner on bail. 2 Accordingly, the petitioner, namely, Ershad Ekbal @ Shabbir shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of Rs. 10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Calcutta. If on bail, the petitioner shall be physically present on each and every date before the learned trial Court and shall not leave the jurisdiction of Kolkata Municipal Corporation without prior permission of the learned trial Court. Thus, CRM (M) 1621 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
