Accused in Crime No.152 of 2026 registered by Amruthahalli Police Station, Bengaluru City for offences punishable under Section 64(2)(m), 351(2), 351(3), 352 of BNS, 2023 and Section 66(c) of Information Technology Act, 2000 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. The written submissions filed on behalf of the defacto complainant is taken on record. 3. FIR in Crime No.152 of 2026 was registered by Amruthahalli Police Station, Bengaluru City for the aforesaid offences against the petitioner herein, based on the first information dated 21.05.2026 received from the victim girl aged about 23 years. In the said case, petitioner was arrested on 24.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in - 3 - HC-KAR CNR: KAHC010391492026 NC: 2026:KHC:39218 CRL.P No. 8263 of 2026 Crl.Misc.No.5177 of 2026 was rejected on 09.06.2026. Therefore, he is before this Court. 4. In the first information submitted by the alleged victim on 21.05.2026, she has stated that petitioner is her relative and is married to Smt. Nandini. She had gone out along with the petitioner and his family members and during such trips, her photographs were allegedly had clicked by the petitioner. In the month of March 2021, petitioner allegedly had called the victim girl over her mobile phone and stated that he would be morphing her images in the photos which he had and would be uploading the same online and asked her to love him. Therefore, the victim girl was pretending as if she was in love with the petitioner. Petitioner, who was a resident of Gadag was frequently visiting Bengaluru and he was allegedly taking the victim girl from her hostel to various hotels in Bengaluru and after making her to consume alcohol, he allegedly had taken her nude photographs and videographs and thereafter, by threatening her, he used to have sexual intercourse with her. He also allegedly had criminally intimidated her and in the month of April 2026, after quarreling with her, he allegedly - 4 - HC-KAR CNR: KAHC010391492026 NC: 2026:KHC:39218 CRL.P No. 8263 of 2026 assaulted her and spoke ill about her mother. It is under these circumstances, FIR was registered against the petitioner in the present case. 5. A reading of the first information itself would go to show that, petitioner is a relative of the alleged victim and she was aware that he is a married man. The first information would suggest that the petitioner and the victim girl were moving together for a considerable period of time. Petitioner, who is a married man having no criminal antecedents is in custody in the present case for the last more than two months. Major portion of the investigation is already completed. Under the circumstances, without expressing any opinion on the merits and demerits of the case, prayer made by the petitioner for grant of regular bail is answered affirmatively. Accordingly, the following:- ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.152 of 2026 registered by Amruthahalli Police Station, Bengaluru City for offences punishable under Section 64(2)(m), - 5 - HC-KAR CNR: KAHC010391492026 NC: 2026:KHC:39218 CRL.P No. 8263 of 2026 351(2), 351(3), 352 of BNS, 2023 and Section 66(c) of Information Technology Act, 2000, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of - 6 - HC-KAR CNR: KAHC010391492026 NC: 2026:KHC:39218 CRL.P No. 8263 of 2026 the said Court until the case registered against him is disposed off.
