2. Mr. Chitrarth Kandpal, learned Brief Holder, for the State of Uttarakhand.

In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Gajendra Singh, who has been accused in Case Crime No.165 of 2025, under Sections 105 & 3 (6) of the BNS, at Police Station Basant Vihar, District Dehradun.
4. The case, as per the prosecution story, is that FIR has been lodged by the complainant namely Smt. Anita Thapa on 22.10.2025, which got registered as FIR no. 165 of 2025 at P.S- Basant Vihar, District- Dehradun, under section 110 of B.N.S., against the four named person & one unknown person with the allegation that her brother- in- law namely Manbahadur Rana who drives E-Rickshaw on 21.10.2025 a child namely Ansh came in front of his E- Rickshaw and got a minor injury after that her brother- in- law stopped the rickshaw then the child parents and a person namely Jagmohan and a person namely Mani @ prince beat Manbahadur Thapa and despite his repeated request that he would get the child treated they still beat him up badly and
after this they took him in their car to his home in Laxmi pur in injured state and at home his wife sent rupees 3000 thousand in cash and rupees 7000/- through UPI in the account of co-accused Mani @ Prince for the child's treatment after that they left from there but soon after her brother-in-law fell unconscious and kept in I.C.U. today her sister told her that the doctor has put him on ventilation and his brain dead.

Learned counsel for the Applicant submits that the Applicant has falsely been implicated in the present matter and the Applicant is languishing in jail since 24.10.2025 and the Applicant has no previous criminal history. He further submits that the Applicant never committed marpeet with the deceased but unfortunately he died on 25.10.2025, after the four days’ of the alleged incident.
6. Learned State Counsel has vehemently opposed the bail application of the Applicant.
7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
8. Accordingly, bail application is allowed. It is directed that the Applicant - Gajendra Singh, who has been accused in Case Crime No.165 of 2025, under Sections 105 & 3 (6) of the BNS, at Police Station Basant Vihar, District Dehradun, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
