Learned advocate appearing for the petitioners submits that the petitioners are the owners of residence who rented out the property and the tenants were carrying out some illegal activities for which a raid was conducted. The petitioners have been subsequently arrested in connection with the instant case. Although they are innocent and are in custody for about 8 months. Charge sheet has already been submitted before the jurisdictional Court. As such, the petitioners pray for bail. Learned advocate for the State opposes the prayer for bail. I have taken into account the materials appearing against the petitioners. So far as the victim is concerned, the petitioners’ name did not transpire. Neither there are

materials to suggest in the alleged flesh trade which has been carried out, the petitioners have any association. The aforesaid observations are tentative but having regard to the materials appearing further detention of the petitioners is unwarranted in the facts of the case. Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, Special POCSO Court, Berhampore. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District Murshidabad without the prior permission of the learned Trial Court. Accordingly, CRM (M) 1220 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
