JUSTICE SURAJ GOVINDARAJ - 3 - HC-KAR CNR: KAHC010478732026 NC: 2026:KHC:38958 WP No. 21710 of 2026 ORAL ORDER 1. Sri Gopal V Bilalmane, learned counsel accepts notice for respondent No.1 to 4. 2. Petitioner is before this Court seeking for the following reliefs: a. Issue a writ or any order or direction in the nature of writ of mandamus directing the respondents to execute a Deed of Conveyance in respect of the schedule property in favour of the petitioner forthwith. b. direct the respondents to pay the cost of the above petition and grant such other and further reliefs, as are just. 3. The petitioner was allotted an industrial plot bearing No.190-A and B of Somapura Industrial Area, 1st Stage, Dabaspet, on 11.08.2010. The petitioner submits that in pursuance thereof a lease-cum-sale agreement also came to be executed on 07.02.2011. The petitioner claims that the petitioner has complied with the conditions of the allotment as also the lease-cum-sale agreement, and in pursuance thereof, the petitioner, on 08.09.2025 at Annexure-H, had written to the respondents to execute a sale deed, which was reiterated by a letter dated 08.09.2025 and 16.02.2025 at Annexure-J. Despite the said correspondence and the respondents not having - 4 - HC-KAR CNR: KAHC010478732026 NC: 2026:KHC:38958 WP No. 21710 of 2026 executed a sale deed, the petitioner is before this Court seeking for the aforesaid reliefs. 4. On compliance with all the conditions of the allotment and/or lease-cum-sale agreement, it is required for the KIADB to execute the necessary sale deed, the petitioner claiming that it has complied with the requirements. The respondents have not executed the sale deed or rejected the request made. 5. In that view of the matter, this Court passes the following: ORDER i) Writ petition is allowed. ii) Respondents are directed to consider the representations of the petitioner at Annexure-H and J and pass necessary orders within a period of 30 (thirty) days from the date of receipt of a copy of this order. iii) It is made clear that this Court has not expressed any opinion on the merits of the matter. - 5 - HC-KAR CNR: KAHC010478732026 NC: 2026:KHC:38958 WP No. 21710 of 2026 iv) The respondents would have to verify, if compliance has been made by the petitioner of the applicable terms and thereafter, pass necessary orders.
