29-07-2026 Item No.48 Subrata Bhattacharyya AR(C) IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction Appellate Side WPA No.17584 of 2025 Jebaunnechha Begam Sekh & Anr. -vs- The State of West Bengal & Ors. Mr. Dilip Kumar Maiti …for the petitioners 1. The petitioners are the heirs and legal representatives of a deceased teacher who retired from service in the year 2007. The Pension Payment Order was issued in the same year. The terminal dues of the teacher were disbursed immediately in the next year. 2. The teacher was alive for nearly ten years after his retirement. He expired on January 20, 2017. After the death of the teacher, i.e. the petitioners’ father, the petitioners have filed the instant writ petition in August 2025 claiming interest on account of delayed payment of the terminal dues of their father. 3. The petitioners failed to appreciate that their father who was the employee never raised any allegation as regards delay in releasing his terminal dues. After his death, the allegation of the legal heirs that there was delay on the part of the authority to release the terminal dues cannot be accepted. 4. The writ petition fails and is hereby dismissed. 5. All parties are to act on the server copy of this order duly downloaded from the official website of this Court. 6. Certified server copy of this order, if applied for, shall be made available to the parties. [Amrita Sinha, J] 2
