JUSTICE M.NAGAPRASANNA ORAL ORDER CHECKED The petitioners are before this Court seeking the following prayers: "a. Quash the FIR in Crime No.72/2025 dated 21.08.2025 registered by the Whitefield Women Police Station and the written Complaint dated 21.08.2025, lodged by the respondent no. 2 herein against the petitioners who are accused no. 1 to 4 for the offences punishable under Section 85 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, and under Sections 3 and 4 of the Dowry Prohibition Act, 1961, pending on the file of the learned 29th Addl. CJM Court, Mayohall, Bangalore City as per ANNEXURE-"A" and "B" b. Grant such other order/s as this Hon'ble Court deems fit to grant in the facts and circumstances of the case to meet the ends of justice." - 4 - HC-KAR CNR: KAHC010591962025 NC: 2026:KHC:39038 CRL.P No. 12723 of 2025 2. Heard Sri. Bhailappa C Balagali, learned counsel appearing for the petitioners, Sri. K. Nageshwarappa, learned HCGP appearing for respondent No.1, Smt. Asma Pasha A, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memorandum of Compromise Petition along with the joint affidavit in that regard. The said joint affidavit reads as follows: “1. We are the Petitioners and Respondent No.2 in the above Criminal Petition and are well acquainted with the facts and circumstances of the case. Hence, we are swearing to this Joint Affidavit. 2. We state that the contents of the accompanying Memorandum of Compromise Petition may be read as part and parcel of this affidavit to avoid repetition of facts. 3. We state that the contents of the accompanying Memorandum of Compromise Petition are true and correct to the best of our knowledge, information, and belief. We further state that the compromise has been entered into voluntarily, out of our free will and consent, without any force, coercion, undue influence, or pressure from any person whatsoever. - 5 - HC-KAR CNR: KAHC010591962025 NC: 2026:KHC:39038 CRL.P No. 12723 of 2025 4. We further state that all disputes and differences between the parties have been amicably settled and Respondent No.2 has no objection to quashing the FIR in Crime No.72/2025 registered by the Whitefield Women Police Station, Bengaluru, and all consequential proceedings arising therefrom. 5. We therefore pray that this Hon'ble Court may be pleased to take the compromise on record and allow the Criminal Petition in the interest of justice and equity.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of Joint Memorandum of Compromise Petition along with the joint affidavit as quoted supra being filed and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in Crime No.72/2025 dated 21.08.2025 registered by the Whitefield Women Police Station - 6 - HC-KAR CNR: KAHC010591962025 NC: 2026:KHC:39038 CRL.P No. 12723 of 2025 and the written Complaint dated 21.08.2025, lodged by respondent No.2 herein against the petitioners who are accused Nos.1 to 4 for the offences punishable under Section 85 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, and under Sections 3 and 4 of the Dowry Prohibition Act, 1961, pending before the 29th Addl.
