1. Mr. Bilal Ahmed, learned counsel for the petitioners.
2. Mr. Sandeep Sharma, learned A.G.A. with Mr. Vijay Khanduri, learned Brief Holder for the State.
3. The S.I. Praveen Kumar, Thana Mallital is present in court along with both the petitioners who were handed over to the S.H.O. only to interact with them since this petition has been filed by both of them to get adequate protection. The parents of both the petitioners are from Punjab. Mr. Praveen Kumar, S.I. after interaction with them and with their family members also contacted the concerned police station and he has been apprised that a First Information Report has been lodged at P.S. City Rajpura of District Patiala, Punjab, on 16.04.2026 bearing FIR No. 0096 of 2026, wherein, the petitioner no. 2 is implicated for the offences punishable under section 96 r/w section 137 of BNS, 2023. The FIR has been lodged by one Mithilesh, the father of petitioner no. 1, implicating petitioner no. 2 with the charge of kidnapping his daughter the petitioner no. 1.
4. Mr. Praveen Kumar placed before this court the detailed report along with copy of the FIR and I peruse the same. As per the report submitted by Mr. Praveen Kumar after due verification and interaction with the family members apprised to this court that the actual date of birth of petitioner no. 1 is 02.10.2008 and, as such, she is minor. He also apprise to this court on instruction from her father the petitioner no. 1 is studying in Class-10th.

Thus, on the basis of report it reveals that the petitioner no. 1 is minor and so far as the petitioner no. 2 is concerned he is below 21 years and has not attained the age of marriage and now FIR has already been registered in Patiala, therefore, at this juncture Mr. Praveen Kumar, S.I., who is present in court, is directed to contact to Punjab Police so that they may take the petitioner no. 2 in custody. Mr. Praveen Kumar, who inform that within two days the father of petitioner will come Nainital to take custody of his daughter.

6. In such view of the matter and taking into
consideration the age of petitioner no. 1 the S.I. Praveen Kumar is directed to make an arrangement to admit the petitioner no. 1 at Nari Niketan at Haldwani today itself. The Superintendent of Nari Niketan, Haldwani, is directed to immediately admit the petitioner no. 1 in Nari Niketan Haldwani and take all measures for her safety and when her father reach there the Superintendent shall facilitate the petitioner no. 1 to interact with her father.
7. Superintendent of Nari Niketan is further
directed to interact with the father of petitioner no. 1 and after due verification the Superintendent can decide to handover the custody of petitioner no. 1 to her father.
8. The close relative of petitioner no. 2 is also present in court, who is the so called cousin sister of petitioner no. 2 Jatin namely Rubi Rani W/o Pawan Singh, Village Bindukhedi Fandpuri Thana Nakud District Saharanpur. The S.I. Praveen Kumar is
directed to take an undertaking of this lady so that if in future her presence is required they can easily contact her.
9. In addition to this, one another person is also present in court namely Akshay Kumar S/o Subhash who belongs to the State of U.P. Let the S.I. Praveen Kumar may also inquire about his past from the State of U.P. and take his undertaking also so that if in future his presence is required the police can easily may contact him.
10. The report of S.H.O. Kotwali and the copy of FIR lodged at P.S. City Rajpura of District Patiala is placed on record.
11. In addition to this, the S.H.O., Nainital, is
directed to take appropriate measures for safety of petitioners, till such time the Punjab Police take custody of petitioner no. 2.
12. Subject to the direction as above, the writ petition is disposed of finally.
