29/07/2026 D/L – 304 Court No.35 S. Kundu C.R.M.(M) 1558 of 2026 In Re: An application for bail under Section 483 of the BNSS, 2023. In connection with Sessions Case No. 702 of 2025 arising out of Jagaddal P.S Case no. 296 of 2025 dated 13/09/2025 under sections 103(1)/238/61(2) of the BNS. In the matter of: Saradindu Mondal @ Jhantu …Petitioner. Mr. Arkadeb Bhattacharyya …for the petitioner. Mr. Subrata Mukherjee …for the State. Learned advocate appearing for the petitioner submits that the petitioner is innocent of charges and he has been unnecessarily detained behind the bars for more than 10 months. There is no possibility of the trial being taken to its logical conclusion and the prosecution has relied upon 40 witnesses in order to prove its case. Learned senior advocate while arguing the case has referred to number of witnesses and emphasized on the issue relating to the petitioner being not last seen amongst the persons with whom the deceased entered into a scuffle or was being threatened. Learned advocate for the State opposes the prayer for bail and submits that the offence was committed in a heinous manner and there were earlier pressure upon the present petitioner. 2 I have taken into account the stage of the case, however, witness action is about to commence. It has been informed that on the last occasion witnesses were not present. The learned trial court is directed to give priority to the evidence of CSW 8 the wife of the deceased. The same may be concluded within a period of three months from date. The petitioner would be at liberty to approach this Court after the evidence of CSW-8 is over. Accordingly, CRM (M) 1558 of 2026 is dismissed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
