The present writ petition has been filed seeking a direction to respondent/ BSES from shifting/ installing any additional transformers, electrical panels, meters, cables etc. for transmitting electricity from the petitioner’s premises situated at Building No.30-31 Raja House, Nehru Place, New Delhi to building bearing No.34-IFFCO building, 35-36, Aggarwal Bhawan, 39-Kushal House, 40-41, Bakshi House, 43-(Mini Market) and 44-Deenar Bhawan, all situated in Nehru Place, New Delhi, to other nearby buildings. 3. A further direction is sought to remove the connection granted from the petitioner’s building to other buildings being building nos. 24, 25, 26, This is a digitally signed order. Attention of the Court has been drawn to the public notices dated 24th January, 2026 and 21st February, 2026 (Annexure P-1 and Annexure P-2 attached along with the writ petition). In terms of the aforesaid notices, the petitioner was notified that the respondent/ BSES has planned the shut down for PSD work at 11 KV substation installed at the petitioner’s building from 11 a.m. to 4 p.m. on 25th January, 2026 and 22nd February, 2026. 5. Counsel appearing on behalf of the respondent/ BSES submits that the scope of the aforesaid Public Notices is only to highlight disruption of electricity supply on account of replacement of existing 11 KV RMU panel and not on account of any shifting of transformers. 6. He further submits that the concern of the petitioner has been addressed by a communication dated 2nd February, 2026, sent by the respondent/ BSES to the petitioner. The relevant extracts from the aforesaid letter are set out below: “Those agreements clearly establish that electrification of Building Nos. 27, 30, 31, 32 and 33 was carried out with the consent of MCD. Accordingly, BSES is statutorily obligated to supply electricity to the said buildings, and no separate consent of the building owner is required for discharge of this duty. It is further submitted that the transformers, HT/LT panels, ACBs, and associated HT/LT cables were installed more than 45 years ago. During that period, several agreements and handing-over/taking-over documents were executed between MCD and DESU, whose successor entities are now MCD/DDA and BSES. With regard to Point No. 5 of your letter, the source of your information appears unreliable. For clarity, it is stated that: In 2020, BSES received a letter from DDA for shifting of a sub- This is a digitally signed order. The Order is downloaded from the DHC Server on 20/03/2026 at 13:41:57 W.P.(C) 3381/2026 station from Building No. 42, as the building was declared dangerous and proposed for demolition/auction. Accordingly, the sub-station was shifted in 2021 to Building No. 37. Again, in 2024, DDA issued a letter for shifting of the sub-station from Building No. 37 due to proposed auction of the said building. BSES replied to DDA, requesting provision of an alternate site and deposit of the estimated cost for network shifting. In this regard, it is categorically clarified and assured that BSES is not shifting any sub-station from Building No. 37 to your client’s building. The present work is limited only to replacement of the existing 11 kV RMU panel for strengthening and ensuring reliable power supply, which is technically essential and unavoidable. Regarding Points No. 7 and 8 of your letter, alleging potential fire hazards, short circuit, or electrocution risks, it is submitted that more than 30 substations are installed in basements or ground floors of buildings in the Nehru Place market area. BSES is a licensed electricity distribution company with over 23 years of operation, and no fire incident has occurred at such substations to date.” 7. The aforesaid communication clearly addresses the concerns of the petitioner with regard to potential fire hazard and shifting of other transformers/ substations from the neighbouring properties to the petitioner’s building. 8. Insofar as the grievance of the petitioner with regard to shifting or transmitting of electricity from the petitioner’s building to any other building, liberty is given to the petitioner to invoke appropriate remedies in law. 9.
