IN THE HIGH COURT AT CALCUTTA CIRCUIT BENCH AT JALPAIGURI CRIMINAL MISCELLANEOUS JURISDICTION
C.R.M. (A) 55 of 2026
In Re : An application for anticipatory bail under Section 438 of the Code of Criminal Procedure read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Dinhata Police Station Case No. 100 of 2025 dated 02.03.2025 under Sections 329(4)/115(2)/109(1)/351(2)/3(5) of the BNS. And In Re : Suman Barman & Ors.
... Petitioners
Mr. Hillol Saha Podder Ms. Mousumi Das
... for the Petitioners
Mr. Kallol Acharjee Mr. Biswarup Roy
... for the State
Heard learned counsels for the parties.
Learned counsel for the petitioners submits that the present complaint is a counterblast of an earlier complaint lodged by one Usha Barman under Section 85 of the BNS and other allied provisions. The petitioners have been falsely implicated.
Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioners barged into the house of the de facto complainant and assaulted the inmates of the house. One of the inmates has succumbed to burn injuries.
2 Considering the material on record, gravity of the offence and prima facie involvement of the petitioners therein, prayer for anticipatory bail is rejected. The application being CRM (A) 55 of 2026 is disposed of. Case Diary be returned. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
