Learned advocate appearing for the petitioner submits that the petitioner is in custody for 172 days, charge-sheet has been submitted, however, no witness action has commenced and there is no possibility of the trial concluding in near future. Learned advocate appearing for the State has drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS. I have taken into account the same along with other attending materials. At this stage, without the evidence of the victim being complete before the trial Court, I am of the opinion that it would not be fit and proper to release the petitioner on bail. As such, prayer for bail of the petitioner in CRM (M) 1566 of 2026 is dismissed.
2 Learned trial Court is directed to commence the examination of the victim within one month from the date of communication of this order. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
