30.07.2026 Serial no. 09 [Srimanta] Ct. No. - 29 CRR 2653 of 2026 In re : An Application under Section 483 of the Code of Criminal Procedure, 1973 corresponding to Section 529 of the Bharatiya Nagarik Sureaksha Sanhita, 2023 -And- In the matter of : XXX … … Petitioner. Mr. Malay Bhattacharyya, Mr. Subhrajyoti Ghosh, Advocates … … For the Petitioner. 1. Petitioner has filed the instant application with a prayer for necessary direction upon the Court below for expeditious disposal of the case arising out of Gopalnagar Police Station Case No. 52/2024 under Section 376 of the Indian Penal Code read with Section 6 of the POCSO Act presently pending before learned Judge, Special POCSO Court, Bangaon. 2. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite parties will have no cause to prejudice and as such service of copy of application upon the opposite parties is dispensed with. 3. Having heard learned Counsel for the petitioner and also considering the fact that the charge was framed on 2 9.5.2024 but since then out of 19 witnesses only 3 witnesses have been examined so far, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. 4. Learned Counsel for the petitioner further submits that the Trial Court has adjourned the matter on several occasions and thereby the fundamental right of the petitioner of speedy trial has been jeopardized. 5. In view of above, the instant proceeding being CRR/2653/2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious trial of the said proceeding and to conclude the same at the earliest, preferably within a period of six months from this date. 6. All parties are to act on the server copy of this order duly downloaded from the official website of the Calcutta High Court. (Dr. Ajoy Kumar Mukherjee, J.)
