PUBLIC PROSECUTOR 2 The Court made the following ORDER: The Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), seeking relaxation of the Condition imposed against the petitioners/Accused Nos.6 & 7 vide order dated 09.02.2026 in Crl.M.P.No.280 of 2026 in Crime No.306 of 2024 of II Town Police Station, Visakhapatnam passed by the learned I Additional District and Sessions Judge-cum-Special Judge for Trial of offences under Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’), Visakhapatnam. 2. The learned counsel for the petitioner submits that the conditions imposed by the learned I Additional District and Sessions Judge-cum-Special Judge for trial of offences under ‘the NDPS Act’, Visakhapatnam, in Crl.M.P.No.280 of 2026 in Cr.No.306 of 2024 of Visakhapatnam II Town Police Station and released the petitioners on bail, have become onerous because of the financial constraints of the petitioner. He is unable to meet those conditions thereby he was constrained to be in the judicial detention quite long time. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 4. The order dated 09.02.2026 in Crl.M.P.No.280 of 2026 in Crime No.306 of 2024 of II Town Police Station, Visakhapatnam passed by the learned I Additional District and Sessions Judge-cum-Special Judge for Trial of offences 3 under NDPS Act, Visakhapatnam, against the petitioners/Accused Nos.6 and 7 is hereby modified as under: The Petitioners/Accused Nos. 6 and 7 shall be enlarged on bail upon execution of a bond for a sum of Rs.1,00,000/- (Rupees one lakh only) each with two sureties for the like sum each, to the satisfaction of the learned II Additional Chief Judicial Magistrate, Visakhapatnam. 5. The residual conditions imposed by the learned Trial Court, in the original order shall remain in force and shall be duly complied with by the Petitioners/Accused No.6 and 7. 6.
