JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos.3 to 5 in Crime No.146/2026 registered by Gundlupete Police Station, Chamarajanagara District, for offence punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023, is before this Court in this petition filed under - 3 - HC-KAR CNR: KAHC010440782026 NC: 2026:KHC:38699 CRL.P No. 9528 of 2026 Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail. 2. Heard learned counsel appearing for the parties. 3. FIR in Crime No.146/2026 was registered by Gundlupete Police Station, Chamarajanagara District, for the aforesaid offences against Lokesh and others based on the first information dated 15.05.2026 received from one Siddaraju, father of deceased Prashanth. Apprehending arrest in the said case, the petitioners had filed Crl.Mis.No.207/2026 before the jurisdictional Sessions Court, which was rejected on 05.06.2026. Therefore, they are before this Court. 4. Perusal of the material on record would go to show that deceased Prashanth was married to accused No.2 Mahalakshmi @ Anju and from the said wedlock they have a child aged about 5 years. In the first information, it is mentioned that accused No.2 had developed illicit relationship with accused No.1 and after coming to know about the same, deceased Prashanth was quarreling with accused No.2 regularly. In spite of advice, accused No.2 had continued her - 4 - HC-KAR CNR: KAHC010440782026 NC: 2026:KHC:38699 CRL.P No. 9528 of 2026 relationship with accused No.1 and therefore, deceased Prashanth had attempted to commit suicide on 07.04.2026 and he was admitted to the hospital. Even after he was discharged from the hospital, accused No.2 continued her relationship with accused No.1 and therefore, on 15.05.2026 Prashanth had committed suicide by hanging himself, leaving behind a video recording on his mobile phone, stating that the accused named in the FIR were responsible for his death. The allegation as against petitioners who are arrayed as accused Nos.3 to 5 in the first information is that they had instigated and had supported the relationship between accused Nos.1 and 2. Considering the nature of allegations as against accused Nos.3 to 5, I am of the opinion that their prayer for grant of bail needs to be answered affirmatively, subject to appropriate conditions. ORDER (i) The petition is allowed. (ii) The respondent – Police or any other police in the State of Karnataka are directed to release the petitioner/accused Nos.3 to 5 in Crime No.146/2026 registered - 5 - HC-KAR CNR: KAHC010440782026 NC: 2026:KHC:38699 CRL.P No. 9528 of 2026 by Gundlupete Police Station, Chamarajanagara District, for the offence punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: a) The Petitioners shall appear before the jurisdictional court within 15 days from the date of receipt of the copy of this order and shall execute a personal bond before the concerned Court, for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the court. b) Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) Petitioners shall not tamper with the prosecution witnesses and they shall co-operate with the police for investigation and appear before them whenever called upon. d) The petitioners shall not involve in similar offences in future.
