30.07.2026 IN THE HIGH COURT AT CALCUTTA Item No.294 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (M) 1611 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Murshidabad Police Station Case No. 883 of 2025 dated 16.09.2025 under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In Re : Mahidul Sk ... Petitioner. Mr. Mrityunjoy Chatterjee, Mr. Arindam Poali, Mr. Debarnab Adhikary ... For the Petitioner. Mr. Kalidas Saha, Mr. Sanjib Das ... For the State. Learned advocate appearing for the petitioner submits that there has been no progress in the case since the last rejection of bail on 08.04.2026 in CRM(M) 412 of 2026. State represented earlier that the CCTV footages have been sent to the expert and the same would be retrieved in the form of a report and opinion would be placed before the learned court. Petitioner being the sole accused, there has been no progress in the case and till date, charges have not been framed. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the gravity of the offence and the plea expressed earlier by the State. The Investigating Officer of the case is directed to immediately collect the 2 report from the concerned department so far as it relates to CCTV footages are concerned. Learned Trial Court thereafter at the earliest would overcome the stage of consideration of charges. At this stage, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail, if there is change of circumstances. The application for bail, being CRM (M) 1611 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
