For the de facto complainant. Learned advocate appearing for the petitioner submits that there has been change of circumstances pursuant to the criminal case being registered. Learned advocate appearing for the de facto complainant also leaves it to the discretion of the Court. Learned advocate appearing for the State opposes the prayer for bail and submits that there are materials in the case diary. Having considered the plea expressed both by the learned advocates for the petitioner and the de facto complainant, I direct that the learned Trial Court, after the charges are framed, would fix date for evidence of the victim. If after the evidence of the victim, the learned Trial Court is 2 confident regarding the change of nature of facts and further social issues concerned, learned Trial Court will not hesitate to release the petitioner on bail on any terms and conditions as it deems fit and proper. At this stage, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 1607 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
