1. The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking issuance of a writ of certiorari for quashing the impugned Scheme dated 27.10.2022 as attached with and adopted by the respondents-PSPCL, vide letter dated 06.12.2022 (Annexure P-1) for compassionate appointment to the wards of deceased PSPCL employees, who had expired before 16.04.2010 to the extent it imposes an obligation to refund of amount of solatium and special pension along with 12% interest, which amount, in the case of the petitioner comes to more than Rs.1 Crore and 10 Lacs for appointment to the post of Clerk, having salary of about Rs.18,000/- per month for initial 03 years (though as temporarily decided by the State Govt., vide letter dated 19.08.2025 (Annexure P-3), 12% interest on the refund shall not be recovered till decision of Cabinet). Further, seeking issuance of a writ of mandamus directing the respondents not to recover any interest on the amount of solatium and special pension in pursuance of appointment letter dated 12.06.2026 (Annexure P-4) or else keep a post of Clerk vacant during the pendency of this writ petition by permitting the petitioner to join an appropriate time. Learned counsel for the petitioner submits that for redressal of his grievances, the petitioner has also submitted representation dated 30.06.2026 (Annexure P-5) to the respondents which is still pending
consideration. He further submits that at this stage, the petitioner would be satisfied, if appropriate directions are issued to the respondents to consider and decide the said representation, by passing a speaking order, in a time bound manner.

4. Mr. Hitesh Verma, Advocate has put in appearance and accepts notice on behalf of the respondents No.1 to 4-PSPCL. Mr. Rohit Ahuja, D.A.G., Punjab accepts notice on behalf of respondent No.5- State. They have no objection to the innocuous prayer made by learned counsel for the petitioner.
5. I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1 to consider and decide representation dated 30.06.2026 (Annexure P-5) submitted by the petitioner expeditiously, by passing a speaking order after affording an opportunity of hearing to the petitioner, preferably within a period of 03 months from the date of receipt of certified copy of this order. Further, the decision taken thereon shall be conveyed to the petitioner.
