And In Re : Md. Anwar Ali @ Md. Anwar Alam ... Petitioner. Mr. Apurba Kumar Datta ... For the Petitioner. Mr. Moyukh Mukherjee, Ms. Nayana Mukhopadhyay ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 4 years 10 months and in spite of the earlier time frame provided, the prosecution has failed to conclude the examination of the witnesses within the scheduled period. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the present is a double murder case. Prosecution is exerting efforts, but because of reasons beyond their control, the examination of the witnesses could not be completed. In view of the aforesaid, I direct that evidence of rest of the witnesses be positively completed within a period of six months from the date of communication of this order. Having regard to the heinousness of the offence as prima facie it appears from the prosecution papers, I am not 2 inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. State would communicate this order to the learned Trial Court. The application for bail, being CRM (M) 1605 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
