Case No.253 of 2026 pending on the file of learned SDJM, Athagada, arising out of Athagada P.S. Case No.116 of 2026 for commission of offences punishable under Sections- 329(3)/ 324(5)/ 336(2)/ 296/ 353(3)/ 3(5)BNS. 3. Learned counsel for the State opposes the prayer. 4. Taking into account the nature of allegations and punishment prescribed, this Court has no iota of doubt that the authority shall scrupulously follow the guidelines laid down by the Apex Court in the case of Arnesh Kumar vrs. State of Bihar & another, (2014) 8 SCC 273 and reiterated in the case of Satender Kumar Antil vrs. Central Bureau of Investigation & another, reported in (2022) 10 SCC 51. 5.
