Present is a writ petition under Article 227 of the Constitution of India filed by the petitioner seeking for the following relief(s):- 10.1 The Hon'ble Court may kindly be pleased to call for entire records pertaining to the case of the petitioner for it's kind perusal; 10.2 The Hon,ble Court may kindly be pleased to issue a suitable writ, order or direction commanding the Learned 1st Additional Principal Judge Family Court Bilaspur, District- Bilaspur (C.G.) to dispose ABHIGYA SAXENA Digitally signed by ABHIGYA SAXENA 2 of/decide Case No. 360A/2022 expeditiously within a period of 03 months or within any other suitable period; 10.3 Any other relief, which this Hon'ble Court may deem fit and proper looking to the facts and circumstances of the case, may also kindly be granted in favour of the petitioner. 3. Learned counsel for the petitioner would submit that the petitioner has filed the present writ petition for the limited prayer that the application under Section 13(a) of the Hindu Marriage Act, 1955 filed by the petitioner before the learned Family Court, Bilaspur is pending since 2022 and till date the evidence of the parties have not recorded, therefore, the learned Family Court may be directed to decide the application filed by the applicant expeditiously within the stipulated time frame. 4. I have heard learned counsel for the petitioner and perused the order-sheets of the learned Family Court which has been annexed as Annexure P/1. 5. Considering the submissions made by learned counsel for the petitioner and considering that the application filed by the petitioner under Section 13(a) of the Act of 1955 is pending since 10.01.2022 and the date of hearing have been adjourned time to time for one or other reasons. However, the case is still pending for examining remaining witnesses of the applicant. Further considering the length of the proceedings that it is pending since 10.01.2022. The 1st Additional Principal Judge, Family Court, 3 Bilaspur is directed to expedite the proceeding of the case and conclude the same as early as possible preferably within the further period of 06 months from the next date fixed before it. 6. It is expected that the parties shall co-operate with the trial of the case and shall not take unnecessary adjournments. 7. The learned Family Court is also directed to decide the application filed by the petitioner in accordance with law on its own merits, after providing proper opportunity of hearing to the parties. 8.
