30.07.2026 IN THE HIGH COURT AT CALCUTTA Item No.292 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (M) 1609 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Tamluk Police Station Case No. 65 of 2025 dated 25.01.2025 under Sections 64/316(2)/108 of the Bharatiya Nyaya Sanhita, 2023 read with Sections 67/67A of the Information Technology Act. And In Re : Sk. Asgar Ali @ Nitu ... Petitioner. Mr. Suman De ... For the Petitioner. Mr. Somnath Adhikary, Mr. Neel Chakraborty ... For the State. Mr. Amit Ranjan Pati, Ms. Swastika Chowdhury, Ms. Ilika Nag, Mr. Avijit Chatterjee ... For the de facto complainant. Learned advocate appearing for the petitioner submits that the petitioner is unnecessarily languishing in jail and there is no possibility of the trial concluding in near future. As such, petitioner prays for bail on any stringent condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that 20 witnesses have already been examined by the prosecution and 6 more witnesses are left to be examined. Learned advocate appearing for the de facto complainant opposes the prayer for bail. I find that petitioner’s prayer for bail was earlier rejected on 14.10.2025 in CRM(M) 1618 of 2025. The 2 prosecution has been progressing very smoothly. Some time is afforded to the prosecution to take the trial to its logical conclusion. At this stage, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1609 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
