The Writ Petition is filed questioning the action of the Respondents in not considering the case of the Petitioner for revised pension as illegal and arbitrary. 2. The Petitioner was appointed as a Divisional Cooperative Officer, Kadapa, on 19.01.1983, and thereafter, he was promoted as an Assistant Registrar and had retired from service on 31.10.2013 on attaining the age of superannuation. During his service, disciplinary proceedings were initiated against the Petitioner with regard to the misappropriation of funds of the Gazetted Officers Cooperative House Building Society Limited, Tirupathi, to a tune of Rs. 3,79,000/-. Pursuant to the departmental enquiry, a penalty of a 10% cut in pension was imposed on the Petitioner, besides recovery of the misappropriated amount with interest at 9%. It is stated that the Petitioner had paid an amount of Rs. 3,79,900/- with interest at 9% per annum and is receiving a pension with a 10% cut. 3. The grievance of the Petitioner is that his pay was regularized pursuant to the Revised Pay Scales, 2010, with the sanction of annual grade increments due on 01.02.2012 and 01.02.2013. Thereafter, the Petitioner had submitted Revised Pension Proposals vide PPO No. 13- 020023/SP in the prescribed proforma for the sanction of a revised service pension, normal family pension, and differential retirement gratuity. As the same is not being considered, a representation was also given on 22.10.2024 to Respondent No. 3. As either of them was not being considered, the present Writ Petition is filed. 3
4. Learned Assistant Government Pleader appearing for Services-II submits that the proposal of the Petitioner along with representation dated 22.10.2024 will be considered as expeditiously as possible and communicate same to the Petitioner. 5. Heard the counsels. 6.
Considering the submissions made and taking note of the fact that the Petitioner had retired from service in the year 2013, the Writ Petition is disposed of with the following directions: i) The Respondent Authorities shall consider the revised pension proposals vide PPO No.13-020023/SP and representation of the Petitioner dated 22.10.2024 as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this Order. ii) There shall be no order as to costs.
