THIS PETITION, COMING ON FOR ORDERS THROUGH VIDEO CONFERENCING / PHYSICAL HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 4 - HC-KAR NC: 2026:KHC:33046 WP No. 17243 of 2026 CORAM: HON'BLE MR. JUSTICE M.I.ARUN ORAL ORDER The petitioners are members of respondent No.4 - Co-operative Society. On the allegation that there has been certain malfeasance and misfeasance committed by the Board of Directors of respondent No.4 - Society, the authorities concerned have initiated an inspection under Section 65 of the Karnataka Co-operative Societies Act, 1959 (for short, 'the Act'). However, as no action has been taken pursuant to the inspection report, the present writ petition is filed with the following prayers: "A. Issue a Writ of Mandamus directing the 2nd Respondent (Registrar of Co-operative Societies) and 3rd Respondent to take appropriate legal action against the errant Board of Directors and Secretary of Sri.Jayabharathi Educational Co-operative Society based on the inspection report vide No.ARB- 50/DOORU/12/2025-26, dated 02.01.2026 as per Annexure-B or in alternative. B. Issue a Writ of Mandamus or any other appropriate Writ, Order or Direction Directing the - 5 - HC-KAR NC: 2026:KHC:33046 WP No. 17243 of 2026 2nd & 3rd Respondent (Assistant Registrar of Cooperative Societies, 3rd Zone to consider the representation dated 22.04.2026 submitted by the Petitioners as per Annexure-A within a time bound period as this Hon'ble Court directs in the ends of Justice; and C. Pass such other or further order(s) as this Humble Court may deem fit and proper in the facts and circumstances of the case;" 2. The learned counsel appearing for respondent No.4 submits that the Board of Directors is not guilty of any of the malfeasance and misfeasance as alleged. 3. However, the learned Additional Government Advocate, upon instructions, submits that the inspection report records certain malfeasance and misfeasance on the part of the Board of Directors of respondent No.4 - Society and the inquiry will be taken to its logical end. 4. In the light of the submission made by the learned Additional Government Advocate, the Writ Petition is hereby disposed of, with a direction to respondent - 6 - HC-KAR NC: 2026:KHC:33046 WP No. 17243 of 2026 Nos.2 and 3, to act upon the inspection report in accordance with law, as expeditiously as possible.
