Mr. Moyukh Mukherjee Mr. Asif Dewan Mr. Mehedi Masud ..for the petitioners Mr. Gurudas Mitra Mr. Utsav Dutta ..….for the State Learned advocate appearing on behalf of the petitioners submits that the petitioners have unnecessarily been implicated in the present case as there is no possibility of the trial commencing. Case has not yet been committed to the Court of Sessions and the prosecution has relied upon 24 witnesses in order to prove its case. Learned advocate appearing on behalf of the State opposes the prayer for bail and submits that case could not be committed as four of the accused persons are absconding. Efforts have been exerted by the police authorities to trace out the accused persons. In view of the charge sheet having been submitted, I direct the learned trial Court to exhaust the process of law against the absconding accused persons, split up the trial of the case and at the earliest commit the case to the Court of Session. At this stage, the prayer for bail of the petitioners is rejected. 2 In view of the incriminating materials appearing against the petitioners, the petitioners would renew the prayer for bail at a subsequent stage of the proceedings. With the aforesaid observations, CRM (M) 1617 of 2026 is dismissed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
