Learned counsel appearing on behalf of the petitioner submits that the petitioner has been intercepted at the airport for carrying 1 kg 420 grams gross weight of ganja and is in custody for more than three months. Complaint has already been submitted before the jurisdictional Court, as such, the petitioner may be released on bail on any conditions.
Learned advocate appearing on behalf of the AIR Customs Authority opposes the prayer for bail.
Having regard to the judgment of Hon’ble Supreme Court in Barnali Bag vs. Union of India (Special Leave Petition (Crl. No. 3641 of 2026) wherein emphasis was laid on intermediate quantity, I am inclined to release the petitioner on bail.
Accordingly, the petitioner, namely, Md. Taiyab shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of Rs. 10,000/- each, one of whom must be local to the satisfaction of the learned Judge, 8th Court, North 24 Parganas at Barasat. If on bail, the petitioner shall be
2 physically present on each and every date before the learned trial Court and shall not leave the district of North 24 Parganas without prior permission of the learned special Court.
Thus, CRM (NDPS) 1483 of 2026 is allowed.
