Learned advocate appearing for the petitioner submits that petitioner is in custody for 2 years and 8 months and on instructions learned advocate for the State submits that 11 witnesses have been examined and the prosecution intends to examine 14 more witnesses in support of its case.
There are no criminal antecedents so far as the present petitioner is concerned and from the C.C.T.V. footage it has revealed that petitioner and another struck the deceased with a brick.
Having regard to the overall circumstances particularly with regard to the period of detention of the present petitioner and there being no possibility of the trial concluding within a
2 reasonable period of time, without entering into the merits of the case, I am inclined to release the petitioner on bail.
Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Md. Imran shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Suri, Birbhum.
If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Birbhum without the prior permission of the learned Trial Court.
Accordingly, CRM(M) 1562 of 2026 is allowed.
