Learned counsel for the respondent No. 1 submits that the instant petition has been filed under Article 227 of the Constitution of India, thereby challenging the order dated 27.06.2024 passed by the Court of Ld. Special Mobile Magistrate, 13th Finance Commission (Sub-Judge), Jammu in case titled “Sudarshan Kumar Mishra vs. Lakshmi Narayan Mishra”, as also the order dated 25.09.2024 passed by 1st Additional District Judge, Jammy in case titled “Sumit Mishra Vs. Sudarshan Kumar Misra and another”. The aforesaid orders have arisen out of the suit filed titled “Sumit Mishra Vs. Lakshmi Narayan Mishra” which has subsequently been dismissed for non-prosecution, as such, the instant petition has rendered infructuous.. 2. Learned counsel representing respondent No. 1 has produced on record order dated 20.02.2026, which clearly reflects that the suit filed by respondent No. 2- Sudarshan Kumar Mishra, has been dismissed for want Sr. No. 52 2 CM(M) No. 232/2014 of prosecution, the interim direction has also been vacated. The documents are taken on record. 3. In view of the aforesaid position, the instant petition is dismissed as having been rendered infructuous.
