JUSTICE ANJAN MONI KALITA ORDER Date : 07-04-2026 Heard Ms. D. Chouhan, learned counsel for the petitioner and Mr. I. Alam, learned counsel appearing for respondent Nos. 1 and 2. 2. The instant contempt petition has been filed by the petitioner for non- compliance of the order dated 20.03.2024, passed in WP(C) No. 6043/2023 wherein a coordinate bench of this Court has directed as follows: "8. The above being said, the fact remains that the petitioner had applied for grant of a fair price shop licence, which is apparently pending with the respondent Nos. 5 and 7. The said representation dated 15.03.2022 not having been decided by the respondent Nos. 5 and 7, the respondent Nos. 5 and 7 are directed to take a decision on the said representation and communicate the decision to the petitioner. The above direction is subject to the condition that the fair price shop licence that had been initially given in favour of the petitioner's brother has not been allotted to some other person. The petitioner's representation should be decided by the respondent Nos. 5 and 7 within a period of 3 (three) months from the date of receipt of a certified copy of this order." 3. Mr. Alam, learned counsel appearing for the respondent Nos. 1 and 2, submits that in terms of the aforesaid order of this Court dated 20.03.2024, a speaking order, dated 01.08.2025, has already been passed, whereby the application of the petitioner has been rejected. He further submits that the said speaking order has already been intimated to the petitioner and therefore, there Page No.# 3/3 is nothing surviving in the matter. 4. It is seen that the aforesaid speaking order dated 01.08.2025 has, in fact, been passed by the competent authority, i.e., the Assistant Director, Food, Public Distribution and Consumer Affairs Branch, Bhergaon, Government of Assam. 5. In view of the aforesaid facts, it is seen that the direction passed by this Court on 20.03.2024 in WP(C) No. 6043/2023 has already been complied with and therefore, nothing survives in this contempt petition.
