This appeal under Section 96 of the Code of Civil Procedure has been 9led by the appellant/defendant assailing legality and correctness of the judgment and decree dated 17.5.2017 passed by 7th Additional District Judge, Raipur, District Raipur (CG) in Civil Suit No.115-B of 2015. By the impugned judgment and decree, the suit 9led by original plainti= Sudhir Kumar Pandey (since deceased) was allowed and the appellant/defendant was directed to pay Rs.1,50,000. During pendency of this appeal, the original plainti= passed away and his legal representatives, i.e., wife and two minor children were substituted on record. 2. This Court on 22.3.2025 referred the matter to the mediation centre of this Court in order to explore the possibility of settlement between the parties. The parties were directed to appear before the mediation centre on 24.4.2025. In light of that order, the mediation proceedings were drawn before the mediation centre of this Court on 24.4.2025 and the parties have amicably settled the dispute. Learned counsel for the appellant submits that as per the instructions received, the conditions prescribed in the mediation report have already been complied with and amount of Rs.50,000 has already been received by Smt. Shriti Pandey alias Rani presently respondent No.(i) in this appeal. 4. In view of the above, learned counsel for the appellant submits that as the matter has been amicably settled between the parties, he may be permitted to withdraw this appeal. 5.
