Punjab SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Article 226 of the Constitution of India with a prayer that this Hon'ble Court may be pleased to issue a writ in the nature of Certiorari quashing the impugned order dated 30.12.2025 (Annexure P-4) whereby the petitioner has been sent on deputation at District Rupnagar instead of transferring her which has forced the petitioner to travel 190-200 km involving 5.5 hours of travel, each way twice every week by totally ignoring the genuine request of the petitioner in a totally illegal and arbitrary manner. The petitioner is aggrieved by the deputation order dated 30.12.2025 passed by Respondent No. 2, whereby she has been directed to serve four days a week at Sub-Centre Dumewal, District Rupnagar, and two days a week at her original posting at Sub-Centre Sohal, District Gurdaspur, compelling her to travel approximately 200 km and spend about 5.5 hours each way twice a week, causing severe hardship and inconvenience. Despite repeated representations seeking transfer to District Rupnagar on matrimonial grounds, which remain pending MEENU 2026.07.20 10:51 I attest to the accuracy and integrity of this document CWP-21050-2026 -2- without any decision, the petitioner seeks quashing of the impugned deputation order and a direction to the respondents to transfer her to Sub-Centre Dumewal, CHC Noorpurbedi, District Rupnagar, or any available vacancy in or near Tehsil Anandpur, District Rupnagar. This Court while issuing notice of motion passed the following order. “The petitioner is aggrieved by the deputation order dated 30.12.2025 (Annexure P-4), passed by respondent No.2, whereby she has been directed to serve 4 days a week at Sub-Centre Dumewal, Rupnagar and 2 days a week at her original posting station at Sub- Centre Sohal, Gurdaspur, which has forced the petitioner to travel 190-200 kms, involving 5.5 hours of daily travel, each way twice every week. Petitioner is also seeking direction to the respondent- department to transfer her at Sub Centre Dumewal, CHC Noorpurbedi, District Rupnagar or any vacancy in or near to Tehsil Anandpur, District Rupnagar. Learned counsel for the petitioner has contended that the petitioner has given many representations seeking her transfer from District Gurdaspur to District Rupnagar, on matrimonial ground, however, the same have not been decided yet. Notice of motion. Since the State/respondents were served with an advance copy of the petition, Mr. T.P.S. Walia, AAG, Punjab has put in appearance and prays for time to get instructions if the above said alleged illegality can be rectified at their own by the next date of hearing, failing which, the Secretary, Department of Health and Family Welfare, shall remain present in Court. To be shown in the urgent list.” In response thereof, reply by way of an affidavit of Dr. Aditi Salaria, Director, Health and Family Welfare (FW), Punjab, has been filed on behalf of respondents No.1 to 4, which is taken on record. That immediately upon receipt of the aforesaid order, the matter was examined at the competent level. The representations submitted by the petitioner on matrimonial grounds, the distance involved between the two stations, and the practical difficulties pointed out before this Hon'ble Court were reconsidered sympathetically and objectively. 7. That after such reconsideration, and with a view to mitigate the hardship expressed by the petitioner while at the same time ensuring continuity of heath services, the competent authority has modified the earlier deputation arrangement. Accordingly, the order dated 30.12.2025 (issued vide letter dated 31.12.2025) has been amended and it has been decided that the petitioner shall perform duties at Sub-Centre Dumewal, District Rupnagar on deputation basis for the entire month except for one day, and the petitioner shall report for duty at her original place of posting i.e. Sub-Centre Sohal, District Gurdaspur, only for one day in a month, so that her salary and service records may continue to be maintained through her original posting station. In this regard, a formal office order dated 16.07.2026 has been issued by the competent authority. A copy of the said order is annexed herewith as Annexure perusal of this Hon'ble Court. This Court, having regard to the aforesaid averments and the office order dated 16.07.2026 annexed as Annexure R-1/T, deems it appropriate to hold that nothing survives for adjudication in the present petition. Learned counsel for the petitioner also has no objection to the same. Accordingly, the same is disposed off, having been rendered infructuous.
