The Petitioner, by filing this Writ Petition, has made a prayer to quash the eviction notice dated 3.8.2026 issued by the Tahsildar, Brahmagiri under Annexure-4. 3. Learned counsel for the Petitioner submits that the Opposite Parties without issuing any notice of registration of any encroachment case have started demarcation of the case land of the Petitioner to find out the real position of the land bearing Khata No.145, Plot No.425, Area Ac 1.82 decimal and installed a demarcation pillar inside the land of the Petitioner. Thereafter, an eviction notice was issued on 03.08.2026 against the encroached persons, who are Digitally Signed Signed by: SIPUN BEHERA Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 18-Aug-2026 18:23:16 Signature Not Verified dead. However, the eviction notice goes against the Petitioner. Hence, this case. 4. Considering the submissions made by the learned counsel for the Petitioner and on perusal of the averments made in this Writ Petition, this Court sets aside the order of eviction notice dated 03.08.2026 issued by the Tahsildar, Brahmagiri under Annexure-4 with a direction to the Tahasildar, Brahmagiri to have a demarcation exercise in the presence of the present Petitioner within a period of one week from today and also share the demarcation report to the Petitioner. The Petitioner is also directed to cooperate with the demarcation exercise as and when the Tahasildar fixes a date. 5. It is further directed that till the demarcation exercise is completed, no coercive action shall be taken against the Petitioner pursuant to the notice dated 03.08.2026 issued by the Tahsildar, Brahmagiri under Annexure-4. 6.
