1. The petitioner has filed this petition with the following reliefs:-
“ 10.1 Issue an appropriate writ, order or direction, particularly in the nature of Certiorari, quashing and setting aside the impugned Resolution/Order passed by the Executive Council of Guru Ghasidas Vishwavidyalaya in its 52nd executive council meeting held on 20.02.2026 at item No. 4, whereby the appeal preferred by the petitioner under Section 35 of the Central Universities Act, 2009 has been rejected. 10.2 Issue an appropriate writ, order or direction directing the respondent University to
3 remove the adverse remarks recorded in the Petitioner's Transfer Certificate and Migration Certificate. 10.3 Issue an appropriate writ, order or direction directing the respondent University to update and reflect the Petitioner's earned academic credits in the Academic Bank of Credits (ABC) Portal, in accordance with the University Grants Commission (Establishment and Operationalisation of Academic Bank of Credits in Higher Education) Regulations,
2021. 10.4 That, this Hon'ble Court may grant any other relief in favour of the Petitioner, which it deems fit in the facts and of the case, in the interest of Justice including costs of the Petition.”
2. Learned counsel for the petitioner submits that the present writ petition arises from the second round of litigation. Pursuant to the liberty granted by this Court in W.P.(C) No. 5427 of 2025, the petitioner preferred a statutory appeal before the Executive Council on 24.12.2025. However, by the impugned Resolution dated 20.02.2026, the Executive Council merely affirmed the
order of permanent expulsion and failed to adjudicate upon the petitioner’s specific grievances regarding (i) removal of the
4 adverse remarks from his Transfer Certificate and Migration Certificate; and (ii) updation of his earned academic credits on the Academic Bank of Credits (ABC) Portal. Such non-consideration, despite the directions of this Court, is arbitrary and unreasonable and has caused serious prejudice to the petitioner’s future educational and career prospects. The continued retention of the adverse remarks and non-reflection of his earned credits effectively impose a disproportionate and continuing civil disability upon the Petitioner. The impugned action is therefore violative of the principles of natural justice and Articles 14 and 21 of the Constitution of India. Hence, the present writ petition.
3. Learned counsel appearing for Respondent Nos. 4 to 8/G.G.U. submits that, insofar as the grievance of the petitioner with regard to the alleged adverse remarks contained in the Migration Certificate is concerned, the same no longer survives for
consideration. He produced the original Migration Certificate of the petitioner before this Court and has submitted that no such adverse remark presently exists against the petitioner. Accordingly, the grievance raised by the petitioner in respect of the alleged adverse remark in the Migration Certificate stands duly redressed. It is further submitted that the academic credits of the petitioner shall be duly updated upon his appearance before the concerned institution and completion of the requisite admission formalities. Learned counsel, therefore, submits that no surviving cause of action remains in respect of the aforesaid grievances
5 and that the writ petition to that extent, does not call for any further adjudication by this Hon’ble Court.
4. Having heard learned counsel for the respective parties and upon
consideration of the submissions advanced by counsel for the respondent Nos. 4 to 8/G.G.U, this Court finds that the grievance of the petitioner with regard to the alleged adverse remark in the Migration Certificate does not survive. The original Migration Certificate has been produced before this Court by learned counsel appearing for Respondent Nos. 4 to 8/Guru Ghasidas Vishwavidyalaya, and upon perusal thereof, no such adverse remark is found to be reflected therein. The said grievance, accordingly, stands redressed. As regards updation of the petitioner’s academic credits, the submission of learned counsel for respondent Nos. 4 to 8 that the same shall be duly updated upon the petitioner’s appearance before the concerned institution and completion of the requisite admission formalities is taken on record and accepted. Accordingly, no further adjudication is warranted in respect of the aforesaid grievances, the petition stands disposed of. Sd/-
