THIS WRIT PETITION IS LISTED FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, AN ORDER IS MADE AS UNDER: ORAL ORDER Sri.Dinesh Rao N., counsel for the petitioners and Sri.Raja Kumar M., Additional Government Advocate for respondent No.3 and Sri.Vasuki K.N., counsel on behalf of Sri.B.C.Prabhakar, for respondent No.4 appeared in person. 2. This petition is filed seeking following reliefs: (i) Issue a writ, direction or order including writ of mandamus directing the respondent Nos.1 and 2 to return the balance amount of group insurance amounting to Rs.15,00,000/- deposited by respondent No.1 to respondent No.4 for being credited to the account of the petitioner No.1. (ii) Direct respondent No.4 to credit Rs.15,00,000/- to the account of petitioner No.1. - 4 - HC-KAR CNR: KAHC010413162021 NC: 2026:KHC:38664 WP No. 20086 of 2021 (iii) Direct respondent No.4 to pay compensation of Rs.1,00,00,000/- to the petitioners towards untimely death of husband of petitioner No.1 and father of petitioner Nos.2 and 3 while extinguishing fire in the 5th respondent unit. (iv) Grant such other and further reliefs as this Hon'ble court may deem fit to grant under the circumstances of the case. 3. Counsel for the respective parties urged several contentions. Sri.Vasuki K.N., counsel for respondent No.4 on instruction submits that the balance amount of group insurance amounting to Rs.15,00,000/- has been paid to the petitioners. Sri.Dinesh Rao N., counsel for the petitioners fairly submits and acknowledges the said submission that the petitioners have received the balance amount of group insurance amounting to Rs.15,00,000/-. 4. As far as prayer No.3 is concerned, petitioners are seeking compensation of Rs.1 Crore under writ jurisdiction. Claims for payment of compensation necessitate a thorough - 5 - HC-KAR CNR: KAHC010413162021 NC: 2026:KHC:38664 WP No. 20086 of 2021 adjudication of disputed facts and evidence, and therefore, cannot be agitated or entertained in a writ petition under Article 226 of the Constitution of India. 5. Accordingly, the writ petition is dismissed. Because of dismissal the Writ Petition, interim order granted if any stands discharged and pending interlocutory applications if any are disposed of.
