Matter is taken up for consideration in presence of learned advocates representing the petitioners, respondent no. 4 and State respondents. 2. It is contended on behalf of petitioners that shares of the petitioners in newly developed property are not provided to them in terms of agreement made between the parties. It is submitted that developer is selling newly developed property without taking note of the terms and conditions of development agreement requiring transfer of certain shares of newly developed property in favour of the petitioners. 3. State respondents and respondent no. 4 are represented by learned advocates who have opposed this writ petition on the ground that issue involved in this writ 2 petition is civil in nature. A communication dated 21st July, 2026 of Inspector-in-Charge Narendrapur Police Station is filed today and same is taken on record. Copies of the said communication dated 21st July, 2026 are made over to the learned advocates representing the petitioners and respondent no. 4. 4. If petitioners find that in breach of agreement made between the petitioners and respondent no. 4 shares in newly developed property are not provided to them, in that event petitioners need to approach civil court in pursuit of remedy. Police authority is not the appropriate authority to decide whether terms and conditions of agreement are breached or not. 5. In aforesaid conspectus, present writ petition is not interfered with and same stands dismissed. 6. However, this order shall not preclude the petitioner to approach appropriate forum in pursuit of remedy. (Saugata Bhattacharyya, J.)
