Mr. Banerjee, learned senior advocate appearing for the petitioner/contempt applicant has brought on record the fact that the petitioner has filed Misc. Case (Act VIII) No.236 of 2026 before the court of learned Additional District Judge, 2nd Court at Barrackpore, praying for custody of the children. Copy whereof is kept on record. He informs that an application for interim relief on account of visitation right is in the process of being filed. In view of the fact that parties are ad idem that all the issues which have been raised in this application particularly relating to visitation right of the petitioner to the child, will be urged before the learned court of the 2nd 2 Additional District Judge, Barrackpore, we do not find any reason to keep this contempt application pending. The contempt application is disposed of on the basis of the submissions of the parties that the point raised in this application will be re-agitated before the learned Additional District Judge, 2nd Court at Barrackpore, including the visitation right of the petitioner.
