Accused no.4 in Spl.C.C.No.1778 of 2023 pending before the Court of XXXIII Additional City Civil and Sessions Judge and Special Judge (NDPS) Bengaluru, arising out of Crime No.38 of 2023 registered by Devarajeevanahalli Police Station, Bengaluru City for offences punishable under Sections 20(b)(ii)C, 8(c) of NDPS Act is before this Court in this successive bail application filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. Petitioner who was arrested in the present case on 27.02.2023, had earlier approached this Court in Criminal Petition No.9329 of 2023, which was dismissed on merits by this Court vide order dated 31.10.2023. Subsequently, petitioner had approached this Court in Crl.P.No.2427 of 2024 which was disposed of with a request to the Trial Court to dispose of the case on merits as expeditiously as possible. - 3 - HC-KAR CNR: KAHC010419482026 NC: 2026:KHC:38787 CRL.P No. 8917 of 2026 Since there was no progress in trial before the Trial Court, the petitioner is before this Court in this successive bail application. 4. Learned counsel for the petitioner submits that, out of 17 charge sheet witnesses cited in the present case, only 4 charge sheet witnesses have been examined as PWs.1 to 4. In the other two criminal cases registered against the petitioner for similar offences, he has been acquitted. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP who has opposed the petition submits that, as against petitioner, three other similar cases are registered and delay in the trial is for the reason that petitioner has not cooperated with the Trial Court. He submits that, CWs.8 to 15 are already dropped before the Trial Court and therefore, this petition may be disposed of with a direction to the Trial Court to dispose of the main case within a time frame. 6. Criminal petition is disposed of with a request to the Trial Court to expedite trial and dispose of the main case as expeditiously as possible, but not later than a period of four months from the date of receipt of copy of this order. 8. In the event, the Trial Court fails to dispose of the main case within the aforesaid time, the petitioner is at liberty to file a fresh bail application before the Trial Court.
