2. The petitioners have filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for following relief:-
“It is, therefore, prayed that this Hon'ble Court may may kindly be pleased to quash and set aside the entire criminal proceedings including Criminal Case RCC No. 34783/202 pending before the Court of Judicial Magistrate First Class, Durg (C.G.) and the FIR No. 56/2025 registered at Police Station Mahila Thana, Bhilai, District Durg for offences under Sections 85 and 3(5) of the BNS, 2023 with the consequential Charge-Sheet / Challan No. 62/2025 dated 20.10.2025, in the interest of justice.”
3. From a perusal of the prayer clause contained in the present petition, it appears that the same is fundamentally defective. Though the petitioners seek quashment of FIR No.56/2025 registered at Police Station Mahila Thana, District Durg, Charge-sheet No.62/2025 dated 20.10.2025 and the consequential criminal proceedings pending in Criminal Case No.RCC/ 34783/2025, the petitioners have failed to even mention the offences for which the charge-sheet has been filed. More importantly, the petitioners have not laid any challenge to the order whereby the learned Trial Court has taken cognizance upon the charge-sheet and initiated the consequential criminal proceedings. The order taking cognizance being the very foundation for continuation of the criminal case before the learned Trial Court, its non-challenge renders the prayer seeking quashment of the consequential proceedings incomplete and legally
3 defective. The petitioners, having invoked the extraordinary jurisdiction of this Court, was expected to assail the foundational
order with due diligence and precision.
4. In view of the aforesaid glaring defects, this Court is of the opinion that the present petition deserves to be dismissed on this ground alone. However, liberty is reserved in favour of the petitioners to file a fresh petition, if so advised, after curing all the defects and laying an appropriate challenge to the relevant orders, in accordance with law.
5. Consequently, while granting the aforesaid liberty, this Court deems it appropriate to impose costs quantified at Rs.25,000/- (Rupees Twenty Five Thousand only) upon the petitioners. The said amount shall be deposited before the Registry of this Court within a period of two weeks from today. Upon such deposit, the Registry shall transmit the said amount to the Government Special School for Intellectually Retarded Girls, Gangapur, Ambikapur, District Surguja, Chhattisgarh, for the welfare of its students.
