JUSTICE RAVI V HOSMANI ORAL ORDER Challenging charge sheet and entire proceedings in CC no.20527/2019 on file of VI ACMM, Bangalore, for offences punishable under Sections 498A, 504, 506 r/w Section 34 of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961, this petition is filed. - 4 - HC-KAR CNR: KAHC010286912019 NC: 2026:KHC:37813 CRL.P No. 6734 of 2019 2. Sri Naveed Ahmed, learned counsel for petitioner as well as Sri Hasan S Magadi, learned counsel for respondent no.2 submits that during pendency of above petition, there was settlement of disputes between complainant and accused- petitioners herein. A joint memo enumerating terms of settlement along with joint affidavit and an application under Section 359 of BNSS for compounding is filed. 3. Complainant and petitioner no.1 are present and are identified by their respective counsel. On interaction, they stated, terms of settlement have been explained to them and after understanding, they have affirmed same out of their free will and volition without there being any threat, coercion and/or undue influence from anyone. Learned counsel submits that some of offences are non-compoundable and taking note of settlement and circumstances especially reunion between couple, seek for quashing of same. 4. Sri Surya Mukundraj L, learned Additional SPP for respondent State though submitted that there were necessary ingredients for offences alleged, would however concede to fact - 5 - HC-KAR CNR: KAHC010286912019 NC: 2026:KHC:37813 CRL.P No. 6734 of 2019 that reconciliation between parties had resulted in resumption of their marriage and therefore appropriate orders may be passed. 5. Heard learned counsel and perused material on record as well as joint memo, joint affidavit and application for compounding. 6. Perusal of charge sheet and material would indicate that offence arose out of marital discord between complainant and petitioner no.1, which has since ended in reconciliation and their re-union. In view of above, continuation of proceedings would be futile and application appears to be bonafide and not due to any ulterior motive. In order to secure ends of justice, petition is allowed, proceedings in CC no.20527/2019 on file of VI ACMM, Bangalore, for offences punishable under Sections 498A, 504, 506 r/w Section 34 of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961, stands quashed.
